Terms & Conditions
By booking a photography session with David LeClair Visuals, you agree to the following terms. These conditions apply to all services, including commercial, event, portrait, and editorial photography.
1. Booking & Payment
A non-refundable retainer of 30% is required to secure your booking. The remaining balance is due on or before the day of the session. Accepted payments include bank transfer, credit card, or other agreed-upon methods. Failure to complete payment may result in the cancellation of your session.
2. Rescheduling & Cancellations
You may request to reschedule a session up to 72 hours in advance. Cancellations made within 72 hours of the session will result in the forfeiture of your retainer. In the event of severe weather or an emergency, we will make every effort to reschedule at no additional cost.
3. Image Ownership & Licensing
David LeClair Visuals retains full copyright and ownership of all images. Clients receive a non-exclusive, non-transferable license to use the final images for personal or commercial purposes as outlined in our agreement. Any use outside of these terms requires prior written consent and may be subject to additional fees.
4. Image Delivery
Final images are delivered in a high-resolution, digital format within 4 weeks of your session, unless a different timeline is agreed upon in writing. We will notify you of any unforeseen delays in the editing or delivery process.
5. Creative Discretion & Use
The photographer retains final creative control over the editing process. You may not alter, edit, or apply filters to the images without prior written consent. David LeClair Visuals reserves the right to use any images for portfolio, marketing, and social media purposes unless you have submitted a written request to opt-out prior to the session.
6. Client Liability
Clients are responsible for the safety and conduct of all individuals at the session location. David LeClair Visuals is not liable for any injuries, damages, or losses that may occur during the session.
7. Dispute Resolution
Any disputes will be addressed through informal negotiation. If a resolution cannot be reached, the dispute will be resolved through arbitration in accordance with the laws of the Province of Ontario.
8. Amendments
David LeClair Visuals reserves the right to update these terms at any time. The updated terms will apply to all future bookings.
